The Government has today published its response to the Lord Chancellor’s fee consultation regarding the handling of complaints about claims management companies by the Legal Ombudsman. These regulations, which have also been laid in Parliament, fix the ‘fee’ paid by the regulated claims management industry to fund our claims management jurisdiction.
The consultation document says: “It is now expected that the Legal Ombudsman will begin taking complaints about claims management companies at the end of January 2015. At this stage, we are working to a start date of 28 January.”
In August 2012 the Government announced its intention to commence section 161 of the Legal Services Act 2007, so that complaints about poor customer service by regulated CMCs could be dealt with by our scheme. Implementation of this policy was originally delayed, as the proposed mechanism in the Act for funding this work could not be imposed.
